Where appropriate, the masculine gender shall include the feminine gender and vice versa, and the singular shall include the plural.

The Purchaser shall be required to furnish Candrina Investments (Pvt) Ltd trading as Glen Forest Memorial Park (GFMP) with certified copies of a valid form of ID, a copy of proof of residential address (Utility bill, bank reference letter, etc.) by e-mail, fax, or delivery by a registered courier/mail service.

A burial rights certificate, which gives the exclusive burial right to each burial stand, shall be issued to the Purchaser upon full and final payment of the purchase price. The Purchaser acknowledges that the burial rights certificate will be subject to the GFMP Cemetery Rules and Regulations as governed by the requirements and regulations of the Cemeteries Act (Chapter 5:04). It is an essential condition of the GFMP Cemetery Rules and Regulations, which document is available for inspection.

No burial stand may be utilized before the official Burial Rights Certificate has been issued and is produced and endorsed accordingly. Lost certificates can be replaced upon verification and cancellation of the old certificate, at a minimal charge as gazetted from time to time by GFMP.

The quality of the burial stand and GFMP's equipment and ancillary services shall be maintained at the required high standard. The construction of the burial stand shall be subject to the GFMP Cemetery Rules and Regulations.

The Purchaser acknowledges that it is a requirement of the Environmental Impact Assessment approval that each grave be lined. The costs of lining are included in the purchase price.

Included in the purchase price is the annual maintenance fee that shall cover the costs of maintaining the area around the burial stand and cleaning the head and tombstones.

Certain special promotions and rates carry their own terms and conditions which apply accordingly.

Data Usage and Privacy

By agreeing to these Terms and Conditions, the Purchaser acknowledges and consents to the use of the data provided to Glen Forest Memorial Park (GFMP) for the purposes of enhancing services and offerings, including, but not limited to, registration for the Mhuri application.

The Mhuri application, which is an integral part of GFMP, provides family heritage and genealogy services. As such, GFMP may use certain data collected from its services to create an account for you on the Mhuri platform. This will enable you to access additional services offered by Mhuri, subject to its own terms and conditions and privacy policy.

GFMP is committed to safeguarding your privacy. Any data used for registering you on the Mhuri platform will be handled in strict accordance with data protection laws and will not be shared, sold, or distributed to third parties without your explicit consent, except where required by law.

You have the right to opt-out of this registration process at any time by contacting GFMP. Your decision to opt-out will not affect your rights to the services provided by GFMP.

Notwithstanding anything to the contrary herein contracted GFMP shall, in the event of the Purchaser failing to pay any sums owing under this agreement on the due date or otherwise committing a breach of any of the conditions hereof and failing to make such payment or remedy such breach within thirty (30) days of the due date, be entitled, without further notice to and prejudice to any other rights available at law to:

Cancel this Agreement, in which event the Purchaser shall immediately restore possession of the burial stand to GFMP and the Purchaser shall forfeit to GFMP any monies paid in terms of this sale as and by way of roukoop; or
Cancel this purchase; GFMP regaining possession of the burial stand and recover from the Purchaser any damages sustained by virtue of breach or cancellation of this Agreement.

Where a credit card is used to pay a burial unit and or related services, a copy of the front of the credit card (showing names, expiry date, and credit card number) shall be required to be furnished to GFMP by e-mail, fax, or by registered courier/mail service. All the charges for the use of the credit card are borne by the Purchaser.

Wherein the Purchaser will fully decide to terminate this agreement, the Purchaser shall be required to deliver to GFMP a written notice together with the Burial Rights Certificate. If mailing the notice and Burial Rights Certificate, the Purchaser shall do so by registered courier/mail service. Refund of the monies paid as of that date shall be subject to a 30% deduction, to cover administration costs. The written notice of cancellation shall detail the preferred mode of payment and also include all the details necessary to successfully effect the refund payment, including the correct postal address.

In the unfortunate event where the Purchaser dies before meeting full payments due to GFMP, GFMP shall refund all the monies paid as of that date subject to a 30% deduction, to cover administration costs. A certified copy of the Death Certificate shall be furnished to GFMP before the release of the refund.

Upon this sale being canceled, the Purchaser shall immediately be dispossessed of and hereby agrees and binds him/herself forthwith to give up possession of the burial stand to GFMP. The Purchaser shall under no circumstances, however arising, be entitled to claim any compensation from GFMP in respect of any additions or improvements made or erected on the said burial stand subsequent to the date of execution of the sale.

In the event of cancellation, the Purchaser shall be required to furnish GFMP with the Burial Rights Certificate before any monies due (if any) are paid.

In the event that GFMP fails to comply with any of the terms and conditions of this Agreement, the Purchaser shall be entitled to give a written notice by registered courier/mail to GFMP requiring it to remedy such within the time stipulated. The Purchaser shall be entitled to cancel this Agreement and reclaim in full monies paid towards the purchase price.

The parties to this Agreement choose domicilium citandi et executandi as follows: GFMP chooses:
Ground, South Block, CABS Head Office Complex, Northridge Park, Borrowdale, Harare, Zimbabwe, whilst the Purchaser's address is as on the reverse, under personal details in the Application of Purchase.

GFMP and the Purchaser acknowledge that this Agreement constitutes the entire agreement between them and no other conditions, stipulations, warranties, or representations whatsoever have been made by either party or their agents other than such as may be included herein.

The Purchaser acknowledges that as at the date of this agreement, the burial site at GFMP may not have been serviced, and the Purchaser further acknowledges that there could be some delay in servicing the property. GFMP undertakes to service the property within a reasonable time. Should servicing not be completed within a reasonable time, the Purchaser has the right to cancel the sale and is further entitled to a full refund subject to the payment and refund policy above.
